Terms of Service

1. Agreement to Terms

By accessing or using Traffic Stores ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Traffic Stores provides a hosted storefront platform that allows businesses to create and manage online product menus and storefronts. The Service includes a free tier, a Commerce tier with online ordering, and a POS tier with point-of-sale capabilities.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Billing and Payments

The Free plan is provided at no cost with no time limit. Paid plans (Commerce and POS) are billed monthly. You may cancel at any time. Cancellation takes effect at the end of your current billing period. Refunds are not provided for partial billing periods.

5. Free Trial

The Commerce plan includes a 30-day free trial. At the end of the trial, you will be prompted to subscribe. If you do not subscribe, your store will revert to the Free plan. No data is deleted.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose, to violate any applicable laws or regulations, to infringe on the rights of others, or to distribute harmful, offensive, or misleading content. We reserve the right to suspend or terminate accounts that violate these terms.

7. Your Data

You retain ownership of all content you upload to the Service, including product information, images, and business details. We do not sell your data to third parties. We store your data on Canadian infrastructure.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

9. Intellectual Property

The Service, including its design, code, and branding, is owned by Traffic Stores. You are granted a limited, non-exclusive license to use the Service for its intended purpose. You may not copy, modify, or distribute any part of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Traffic Stores shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months prior to the claim.

11. Indemnification

You agree to indemnify and hold harmless Traffic Stores, its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Service or your violation of these terms.

12. Termination

We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting us. Upon termination, your data may be deleted after a reasonable retention period.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via the email associated with your account. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the Province of Saskatchewan, Canada. Any disputes shall be resolved in the courts of Saskatchewan.
